Time Impact and Delay Claims Avoidance, Management, and Resolution in the Current Volatile Construction Market | Approved for 1.5 AIA LUs

Before starting a project, be prepared to manage common project contract and execution issues, which typically cause claims and influence the resolution of disputes. Learn the basics through discussion of typical disputed matters from inception (i.e. a change order request, notice of claim) through entry into dispute resolution proceedings (direct principal-to-principal negotiation, mediation, arbitration, and litigation). The presentation will focus on the common causes of scheduling issues, time impacts and delay claims and disputes, the importance of appropriate notification, contemporaneous documentation of critical path schedule impacts, and how to determine the financial impacts of a delay and ultimately resolve a project dispute. This discussion is relevant for all levels of project participants and will explain what claims are, why claims are filed, and how to seek to resolve time impact claims on a principled basis.

Presented by Tom Powell & Brian Jeffers of Offit Kurman
The session will focus on project acquisition and procurement as well as innovative project delivery methods to maximize competitiveness, manage risk, and deliver economically successful projects. The session take a deeper dive into Joint Ventures: Teaming Agreements, construction manager (At Risk and Advisor, Design-build and Design-bid-build). Identifying risk and addressing high/low reward requirements in public and private solicitations. Recognize risks accepted and remedies available under construction contracts.

Improving Leadership Mitigates Risk in a Volatile Construction Market | Approved for 1 AIA LU
Presented by Josh Quinter of Offit Kurman
The construction industry is a fluid environment. The need to adapt to an ever-changing landscape on a project can be managed in a variety of ways; but experience suggests the often over-looked topic of leadership has perhaps the biggest impact on risk mitigation. Leadership skills – including effective communication techniques, creating an ownership mentality, and proper delegation, among others – prevent problems from even occurring and make it easier to solve them if they do arise. Good leaders are in high demand in a current market challenged by labor shortages, supply chain issues, and other problems that require companies to do more with less. This presentation will explore the differences between leadership and management, the important elements of good leadership, and various styles of leadership. The desired result will be to provide tools for those in attendance to build effective teams that limit risk and get projects to completion efficiently.
